ARTICLE 1 - Purpose 

This contract determines the rights and obligations of the company MAISON PERROTTE and the Customer in the context of the sale of goods offered through the website https://www.maison perrotte.fr/.

The general conditions of sale constitute the entirety of the rights and obligations of the parties, and no other condition may be incorporated into them. It is not possible to purchase a property on the maisonperrotte.fr website without accepting the present terms and conditions of sale.

Maisonperrotte.fr reserves the right to modify these terms and conditions of sale at any time.

ARTICLE 3 - Characteristics of goods and services offered

The company MAISON PERROTTE informs the customer of all the essential characteristics of the goods offered.

Generally speaking, these characteristics concern the dimensions, weights, quantities, colors and components of the goods offered. These characteristics appear in support of the photograph illustrating the offer. The consumer acknowledges that the photograph representing the product on the website is for information purposes only. 

The products presented on the site comply with current French legislation and standards applicable in France. Unless otherwise specified, MAISON PERROTTE does not limit the geographical scope of its offer.

The offer of products is valid as long as they are displayed to the customer on the site maisonperrotte.fr

The customer is aware that the goods will be delivered by post.

ARTICLE 4 - Contractual terms

Orders on the maisonperrotte.fr website are placed in French and in euros.

The steps required to place an order on the maisonperrotte.fr website are detailed on the maisonperrotte.fr website. It is necessary to create a customer account in order to place an order on the maisonperrotte.fr website.

Once the products have been selected, the customer can confirm the order and modify the contents of the basket before finally validating the order. The required personal information (surname, first name, e-mail address, billing address, delivery address, method and details of payment) are requested from the customer before final validation of the order. MAISON PERROTTE cannot be held responsible for any errors made by the customer in entering this information, nor for any delays or errors in delivery.

ARTICLE 5 - Price of goods and services

All prices are quoted in euros and include VAT, but exclude delivery costs.

Sales prices may be modified by maisonperrotte.fr at any time, but we undertake to apply the current prices indicated at the time of your order.

If, as part of a sponsorship program (with your bank, for example), you have obtained an advantage code. Advantage codes cannot be used in conjunction with sales, private sales, event sales or any other operation offering discounts on products on sale. If you use an advantage code and your basket contains products that are already discounted, the code will still be applied, but will not take into account products that are not discounted.

ARTICLE 6 - Conclusion of online contract

Orders can be placed either on the maisonperrotte.fr website (www. maisonperrotte.fr), or by telephone on 09 86 11 54 22 (price of a local call).

The electronic contract will be established after double validation by the customer: 

  • If the customer so wishes, he can register his order by clicking on the "Place my order" button on the basket consultation page.
  • The order will then be validated by the customer by clicking again on the "Confirm my order" button on the order validation page.

To ensure the customer's willingness, the company MAISON PERROTTE undertakes to confirm all orders by e-mail. On this confirmation will appear the mention of the ordered good, its price, the method of payment as well as its modalities of delivery by e-mail at the latest at the time of the delivery.

In addition to accepting the content of the order, this validation implies acceptance of the entirety of these general conditions of sale.

ARTICLE 7 - Payment

To pay for their order, customers can choose from the following payment options:

    • by PayPal account
    • by credit card Visa, Eurocard/Mastercard, American Express
    • by cheque (France only)
    • by bank transfer

For payments by PayPal account, the debit is made when the order is validated, on condition that you have previously obtained authorization to debit your account from the relevant payment centers, failing which the order cannot be taken into account.

The payment order may be revoked in the event of fraudulent use of the card, in accordance with the agreement between the customer and his bank.

Online payment by credit card is made in a secure environment using the "Secure Socket Layer" security system. "Secure Socket Layer" security system which encrypts your bank details as they are transmitted over the network.

In the case of payment by cheque, the electronic contract will only be concluded on receipt of the cheque. Consequently, the order will be dispatched once the cheque has been received and cleared. For this reason, not all delivery options (in particular the choice of delivery time slot) are available when paying by cheque. Finally, the customer has a period of seven (7) days in which to send the bank cheque by post. The order is automatically cancelled if payment is not received and this period is exceeded.

In the case of payment by bank transfer, the electronic contract will only be concluded upon receipt of the exact amount in our bank account. Consequently, the order will be dispatched once the exact amount has been received in our bank account. For this reason, not all delivery options (in particular the choice of delivery time slot) are available when paying by bank transfer. Finally, the customer has a period of seven (7) days in which to make the bank transfer. The order is automatically cancelled if payment is not received and this period is exceeded.

The customer certifies that he/she has the necessary authorizations to make the payment he/she chooses.

ARTICLE 8 - Right of withdrawal and withdrawal period

maisonperrotte.fr wants any customer who is not satisfied with the products ordered on the website to be able to exercise their right of withdrawal under the best possible conditions.

Article L.121-21 of the French Consumer Code stipulates that the customer has a period of fourteen (14) days to exercise his right of withdrawal, and that the goods must be returned within fourteen (14) days of communication of the decision to withdraw.

The customer returning the product within this period has the right to an exchange or reimbursement of the price of the product ordered and reimbursement of the outward delivery costs. Products must be returned in perfect condition for resale, in their original state (packaging, accessories, instructions, etc.) and duly sealed.

All Products can be retracted, except those excluded by law in article L121-21-8 of the French Consumer Code, for example Products that have been personalized at your request, Fresh Products, etc...

maisonperrotte.fr will acknowledge receipt of your cancellation by email.

You must then return the Products to maisonperrotte.fr, no later than fourteen (14) days after your withdrawal by Post to the following address: MAISON PERROTTE 289 rue Benjamin Guittonneau 49260 Vaudelnay.

In the event of a dispute, the customer may have recourse, free of charge, to a consumer mediator with a view to an amicable resolution, whose contact details are given below:

ARTICLE 9 - Repayment terms

In case of exercising the right of withdrawal, the company MAISON PERROTTE undertakes to reimburse the customer the sums paid and without charge within a maximum period of 14 days from receipt of products.

The customer may also choose to exchange the product.

ARTICLE 10 - Delivery

General rules

maisonperrotte.fr undertakes to deliver the products ordered within 30 days of the order.
If one of the products is unavailable or out of stock, the customer will be informed as soon as possible and may cancel the order. The customer may then request an exchange of the product or a refund.

Products are delivered to the address indicated by the customer on the order form, in mainland France.
Invoices will be sent by e-mail to the e-mail address indicated by the customer when creating a customer account or placing an order.

All complaints must be sent to the address indicated in article 2. The customer will check the general appearance of the packaging of the product delivered; in case of damage, it undertakes to report on the order form. In addition, he will notify the company MAISON PERROTTE within 3 days by phone at 09 86 11 54 22 (price of a local call). In the event of non-conformity of the goods delivered, the company MAISON PERROTTE undertakes to exchange the product or refund the customer.
Our products are subject to the legal warranty against hidden defects which render the products unfit for consumption, in accordance with articles L. 217-4 et seq. of the French Consumer Code. If you discover a hidden defect in our products, please contact us to find out how to make a claim and obtain a refund or replacement of the product.

maisonperrotte.fr makes every effort to fulfill orders on the delivery dates requested by the customer when placing the order. As soon as an order is validated by the customer and payment has been authorized, the order is dispatched the same day if the order was placed before 11am, and on the working day following validation of the order after 11am. The customer's choice of delivery date is an indication which has no contractual value.

Delivery rates

maisonperrotte.fr applies a sliding scale of prices according to the amount of the order before shipping costs.
When using discount coupons, the amount of the order before discount and before shipping costs is used to define the amount of the shipping costs.

Orders containing fresh produce

Fresh products require special packaging to keep them at the required temperature until delivery. Therefore, for all orders containing products requiring refrigeration between 0 and +4°C, delivery must be made by express transport.

Additional time may be required for fresh produce orders, depending on product availability. So that the recipient can be present at the time of delivery, maisonperrotte.fr will contact the recipient to arrange a delivery date.

The recipient undertakes to be present at the time of delivery of an order containing fresh products. maisonperrotte.fr cannot be held responsible if the cold chain has been broken because the recipient was not present at the time of delivery.
It is the recipient's responsibility to check the condition of the package in the presence of the deliveryman or carrier. Any anomaly upon receipt must be reported to contact@maisonperrotte.fr within 48 hours in order to initiate a refund procedure with the carrier.

Customs

For all parcels shipped outside the customs territory of the European Community, the customs documents summarize the total value of the contents of your order and the description of the items.

Customs or import taxes are due as soon as the package reaches its destination country. Any additional taxes due for customs clearance upon delivery are at the customer's expense. 

ARTICLE 11 - Personal information

For the proper processing of the order, the personal data collected (surname, first name, full address, e-mail and telephone number) will be subject to computer processing, of which the customer acknowledges being aware.
In this respect, information concerning the customer may be communicated to the company's commercial partners for the sole purpose of fulfilling the order and delivering the products.
In addition, in accordance with article L.223-3 of the French Consumer Code, the customer may register on a list of persons opposed to telephone canvassing ( bloctel system).

In no case, maisonperrotte.fr will communicate the personal information of its customers to third parties for commercial purposes.
The customer has a right to access and rectify any information concerning him in the files of the company MAISON PERROTTE.

ARTICLE 12- Applicable law

The parties agree that these terms and conditions of sale are governed by French law.

ARTICLE 13 - Settlement of disputes

In the event of a dispute arising from the present contractual relationship, the parties undertake to seek an amicable solution before taking any legal action.
Any dispute relating to the interpretation or execution of the present general terms and conditions of sale will, in the absence of amicable agreement, be referred to the competent courts.

ARTICLE 14 - Force Majeure

The parties shall not be held liable or in breach of their contractual obligations where failure to perform their respective obligations is due to force majeure.

The following are considered to be cases of force majeure: civil or foreign war, riots, acts of terrorism, total or partial destruction of production or other premises and installations, manufacturing incidents, transport disruptions, supply difficulties, customs measures of any nature or origin whatsoever, or any other fortuitous event which prevents or delays in whole or in part the performance of maisonperrotte.fr's obligations.

If the force majeure event lasts for more than one (1) month, the customer will have the option of cancelling the current order and will be reimbursed in accordance with the conditions set out in article 9 of these general terms and conditions of sale.

ARTICLE 15 - Partial invalidity

Should one or more provisions of these general terms and conditions of sale be deemed unlawful or invalid, such invalidity shall not entail the invalidity of the other provisions of these terms and conditions, which shall remain in full force and effect.

ARTICLE 16 - Proof

These order confirmations will be archived at the center of the company MAISON PERROTTE and will be considered as proof of the nature of the agreement and its date within the meaning of the law of 13/03/2000.
